Please read carefully. These Terms contain a binding individual arbitration agreement and a class-action waiver (Section 17) that affect how disputes are resolved, a medical and assumption-of-risk disclaimer (Section 4), and a limitation of liability (Section 14). By using FUEL//TRACK you accept all of them.
FUEL//TRACK (the "App," together with any related services, the "Service") is operated by FuelTrackLLC, a Texas limited liability company ("FuelTrack," "we," "us," or "our"). These Terms of Service ("Terms") form a binding agreement between you and FuelTrack. The App is distributed exclusively through the Apple App Store and is governed additionally by our End User License Agreement ("EULA") and our Privacy Policy, each incorporated here by reference. If any conflict exists, the EULA governs the software license, the Privacy Policy governs data handling, and these Terms govern everything else.
By downloading, installing, accessing, or using the App, or by tapping "I understand & agree," you accept these Terms, the EULA, and the Privacy Policy. If you do not agree, do not use the App.
You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) and able to form a binding contract. The App is not directed to children under 13, and we do not knowingly permit their use. The App is intended for personal, non-commercial use by an individual managing their own nutrition and wellness data. You represent that all information you provide is accurate and that you are using the App for yourself, not on behalf of another person, except where the App expressly allows shared features.
The App is a nutrition and wellness tracking tool. It provides, among other features: calorie and macronutrient logging (including barcode scanning that retrieves third-party product data); an "adaptive" maintenance-calorie and target estimator derived from the data you enter; optional modules for diabetes/blood-sugar reminders, pregnancy nutrition baselines, recovery, and menstrual-cycle awareness; on-device storage and caching of your data (including local SQLite/device storage); server-side asynchronous calculations performed on inputs you submit; an optional "Squad" feature that shares a limited set of your figures with other users you choose; and an optional auto-renewing subscription billed through Apple. Features may change, be added, or be removed at any time.
The App is for general informational and educational purposes only. It is not medical advice, clinical advice, diagnosis, or treatment, and it is not a medical device. FuelTrack is not a healthcare provider, dietitian, physician, or pharmacist, and no provider-patient or fiduciary relationship is created by your use of the App.
Every figure the App produces — including calorie and macro targets, adaptive expenditure ("TDEE") estimates, blood-sugar reminders and timing, pregnancy and gestational nutrition baselines, recovery and menstrual-cycle inferences, satiety, hydration, and micronutrient outputs — is an estimate generated from the information you enter and from third-party data, and may be inaccurate, incomplete, or unsuitable for you.
Never disregard or delay professional medical advice because of anything in the App. If you may be experiencing a medical emergency, call your local emergency number immediately. You knowingly and voluntarily assume all risk arising from your use of the App and from any decision you make in reliance on it.
Certain features may require an auto-renewing subscription. Subscriptions are sold and billed exclusively by Apple through your Apple Account, not by FuelTrack, at the prices displayed in the App (currently $8.99 per month or $64.99 per year, plus applicable tax; prices may vary by region and may change).
Nutrition and product data are provided by Open Food Facts contributors under the Open Database License (ODbL); such data is community-sourced and may be inaccurate, incomplete, or out of date. Lookups are routed through our proxy and feedback through a third-party form service. We do not control and are not responsible for third-party data, services, or their availability. Your use of third-party data is at your own risk and subject to the providers' terms and licenses.
If you create or join a "Squad," a limited set of your data — your chosen handle, your logging streak, and your daily percentage of your calorie target — is transmitted to our servers and made visible to other Squad members. You are responsible for the content you share and for choosing whom you share with.
You acknowledge that these Terms and the EULA are between you and FuelTrack only, and not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of the EULA and may enforce it against you. Your use of the App must comply with the App Store Terms of Service and Usage Rules. The detailed Apple-required terms are set out in the EULA.
Your right to use the App software is a limited license granted under, and subject to, the EULA. We and our licensors retain all right, title, and interest in the App, including all intellectual property.
You will not: reverse engineer, decompile, or attempt to extract source code except as permitted by law; circumvent security, rate limits, or the Apple billing system; use automated means to access the Service; misuse the Squad or server endpoints; upload malware; or use the App to provide medical, dietetic, or professional services to third parties.
"FUEL//TRACK," the logo, and the App's design and content are owned by FuelTrack or its licensors. If you send feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY DATA, ESTIMATE, OR CALCULATION IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, FUELTRACK AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY PERSONAL INJURY OR HEALTH OUTCOME, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT, OR (B) USD $100. Some jurisdictions do not allow these limits; where prohibited, our liability is limited to the smallest amount permitted by law. Nothing in these Terms limits liability that cannot be limited by law (such as for gross negligence, fraud, or death or personal injury caused by our negligence where applicable).
You will defend, indemnify, and hold harmless FuelTrack and its members, managers, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) any health, dietary, medical, financial, or other decision you make in reliance on the App; (c) data you enter or share, including through the Squad feature or about other persons; (d) your violation of these Terms, the EULA, the Privacy Policy, applicable law, or third-party rights; and (e) your provision of the App's outputs to any third party.
You may stop using the App at any time and delete it. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections that by their nature should survive (including 4, 12, 13, 14, 15, 17, and 18) survive termination.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of this Section.
Binding arbitration. Except for (i) qualifying small-claims matters and (ii) claims for injunctive relief to protect intellectual property, you and FuelTrack agree that any dispute arising out of or relating to these Terms or the App will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration is Texas; proceedings may occur remotely.
Class-action waiver. Disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any representative proceeding.
30-day opt-out. You may opt out of this arbitration agreement by emailing justin@fueltrack.llc within 30 days of first accepting these Terms, stating your name and intent to opt out. If you opt out, disputes will be resolved in the state or federal courts located in Texas, and you and FuelTrack consent to their jurisdiction and venue.
Nothing here prevents you from contacting Apple or pursuing rights you have under Apple's terms, or from exercising any non-waivable statutory rights in your jurisdiction.
If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, the EULA, and the Privacy Policy are the entire agreement between you and FuelTrack regarding the App. We may modify these Terms; we will update the "Effective" date and, for material changes, provide reasonable notice in the App. Continued use after changes take effect constitutes acceptance.
