FUEL//TRACK · FuelTrackLLC (a Texas limited liability company) · Effective June 23, 2026
This End User License Agreement ("EULA") is a binding agreement between you and FuelTrackLLC, a Texas limited liability company ("FuelTrack," "Licensor," "we"). It governs your license to use the FUEL//TRACK application software, including updates and on-device data files (the "Licensed Application"). It supplements our Terms of Service and Privacy Policy. By downloading or using the Licensed Application, you agree to this EULA.
You and FuelTrack acknowledge that this EULA is concluded between you and FuelTrack only, and not with Apple Inc. ("Apple"). FuelTrack, not Apple, is solely responsible for the Licensed Application and its content. This EULA does not provide usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions, and if any conflict exists, the Apple terms govern to the extent of that conflict.
FuelTrack grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules, for your personal, non-commercial use. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, sublicense, copy (except as expressly permitted), modify, reverse engineer, decompile, or disassemble the Licensed Application, except to the extent such restriction is prohibited by applicable law.
FuelTrack is solely responsible for providing any maintenance and support services for the Licensed Application, as specified in the Terms of Service or as required by law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the Licensed Application.
FuelTrack is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The Licensed Application is otherwise provided "as is" and "as available" as described in the Terms of Service. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be FuelTrack's sole responsibility.
FuelTrack, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit and HomeKit frameworks (if any); and (d) claims relating to the App's health, nutrition, and wellness functionality. This EULA does not limit FuelTrack's liability beyond what is permitted by applicable law.
In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, FuelTrack, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.
You represent and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement and the terms or licenses applicable to third-party data such as Open Food Facts).
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.
The Licensed Application stores and caches your data locally on your device (including in a local database). That data is under your control and is protected primarily by your device's own security. FuelTrack is not responsible for loss of locally stored data resulting from device loss, failure, deletion, or your removal of the App. You are responsible for maintaining your own backups, including via the App's export feature where provided.
FuelTrack may make updates available. Some updates may be required for continued use. This EULA governs any updates unless a separate license accompanies them.
This license is effective until terminated. Your rights under it terminate automatically without notice if you breach any term. Upon termination, you must stop all use and delete the Licensed Application. Sections 4, 5, 6, 10, 11, and 14 survive termination.
Except to the extent the App Store terms or applicable mandatory law provide otherwise, this EULA is governed by the laws of the State of Texas, and disputes are subject to the dispute-resolution provisions of the Terms of Service.
